List of NVC cases stuck in the Anthrax Decontamination

This year started out with a bang for the DOS Liaison Committee regarding India.  First, we had the police certificate policy to clarify, and then we started receiving stories from Indian immigrant visa applicants in Chennai who were being told that the post could not process their cases because they did not have their paper files from the National Visa Center ("NVC").  These cases are not adjustment cases opting for consular processing after filing an I-824.  These cases are I-130 and I-140 cases bound for consular processing from the beginning. 

It appears that Chennai is the only post requiring NVC to send them cases via diplomatic pouch.  Thus, the pouch went to DC to the DOS mailroom and got held up in the anthrax decontamination.   Applicants were told by Chennai that the electronic file from the NVC was insufficient to proceed with their case.  The Visa Office is still working on this issue.  For a longer range fix, they are working on an amendment to 9 FAM 42.42 N1 to specifically mention NVC electronic records as acceptable substitutes for lost petitions.  In the meantime, discussions continue.  At the moment, the post has said that they will accept attorney certified copies of the petition and support documents, but they want the original I-797 approval notice on the I-130 or I-140.   We are trying to get them to accept the NVC electronic records.  In the alternative, NVC has printed their records and is sending them to Chennai via DHL.   We are not sure if Chennai will budge once they receive the DHL, but we hope so.

As to the question, how do I know if my Chennai immigrant case is stuck in the anthrax decontamination?  See below for the list of the NVC numbers for the cases.  If your case is on the list, you may end up having to come up with another original I-797 and the attorney certified copies of the petition and support documents.
